I samband med att miljöbalken trädde i kraft 1999 infördes ett nytt system med miljösanktionsavgifter. Miljösanktionsavgifterna skall påföras näringsidkare som inom ramen för sin näringsverksamhet överträder vissa bestämmelser. Miljösanktionsavgiften är oberoende av uppsåt eller oaktsamhet och skall påföras om det inte är uppenbart oskäligt. Beloppen utgår med lägst 5000 kronor och högst 1000 000.
Ansvar för förorenade områden regleras i 10 kap. MB. I första hand är det verksamhetsutövaren, dvs. den som har drivit en verksamhet eller vidtagit en åtgärd som bidragit till föroreningen, som är ansvarig för efterbehandling.
