近世中国地权具有多层次的权益与功能,相互关联,彼此促进。最基本的是耕作权,在流动与交易中实现土地与劳动力的动态结合,租佃制就是其中一项以未来劳动收入或土地收益贴现的农地租赁制度。其次是土地增值权益,由于未来收益具备产权保障与激励,并可通过交易而变现,从而促进了人们对土地的投资。再次,以土地为中介的多样化交易形式具有跨期调剂的金融功能,满足了农民的融通需求,在一些交易中还萌生了推动地权交易的票据化现象。地权明晰促进土地流动;地权形态的多层次性促进其可交易性;多样化交易形式又推动地权与生产要素的动态组合,从而提高土地产出与经济效率。也因此,土地在流动与资源配置中增进了产权所有者的各种权益与财产的安全性,并提供多样化选择。由于农地的权能是多层次的,并事关过去和未来的长时期分配,因此,如果没有明确界定的地权及其收益分配,土地的流转与交易就会出现障碍而受阻。
